1. Acceptance of the website's terms and conditions

By reading and accepting this agreement, you declare that you are of legal age and have the capacity to enter into contracts, and that you have read and accept these General Terms and Conditions of Use. In any case, access to www.practicatest.com (hereinafter PracticaTest) by any user implies acceptance of the specific conditions that each service entails, so prior to accessing or using such content, the user must read these Terms of Use.

2. Privacy policy and data protection

By merely visiting the PracticaTest website, visitors do not provide any personal information nor are they required to do so in order to browse it. Pursuant to the Organic Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD), we inform you that the personal data you provide to this website will be entered into an automated file owned by PracticaTest for the purpose of internally managing the services offered. Users who provide their personal data to PracticaTest give their express consent for it to be shared with companies within the PracticaTest group for the purpose of carrying out activities related to their operations. The user guarantees the accuracy of all data provided to PracticaTest, keeping it updated in the event of any changes, in order to reflect their real situation at all times and to collaborate with PracticaTest's operations, being solely responsible for any false statements made and any damages caused to PracticaTest or third parties. PracticaTest assumes no responsibility arising from incorrect, inappropriate, or unlawful use of the information appearing on the PracticaTest website. No responsibility is assumed for any inaccuracy or lack of precision in the content included on the website, within the limits established by law. PracticaTest pages may occasionally contain links to websites managed by third parties, and therefore PracticaTest is not responsible for the content and texts that appear on them. PracticaTest is not responsible for the misuse that users may make of their passwords, and it is the users' responsibility to properly safeguard these and the rest of their personal data. Your acceptance of these terms of use constitutes consent for PracticaTest to send you promotional communications by email or other means under the terms established in Law 34/2002 on Information Society Services and Electronic Commerce. To stop receiving such communications, you may contact PracticaTest by sending an email to [email protected] expressing your wish. If you do not wish to receive some or all of our Newsletters, Registered Users and Premium Users may unsubscribe at any time. To do so, they must unsubscribe by clicking the link at the bottom of each Newsletter received by email.

3. Exercise of rights of access, rectification, cancellation, and objection of data.

PracticaTest users may cancel the personal data entered on the website, with PracticaTest blocking such data, although some information will be retained by PracticaTest in compliance with its legal, fiscal, and tax obligations. PracticaTest users shall at all times have the right to exercise actions of access, rectification, cancellation, and objection by contacting us via email at [email protected]

4. Intellectual property of the PracticaTest.com website

Any act of transmission, distribution, transfer, reproduction, storage, or public communication, whether total or partial, of the content, services, communications, or any other information published on PracticaTest.com is fully and expressly prohibited. PracticaTest owns and holds all rights over the content, design, and source code of the website, especially the educational content offered to its users. These rights are applicable in our territory according to current legislation and are enforceable against third parties in the event of unauthorized copying. It is the user's obligation to respect PracticaTest's copyright, and it is prohibited to use, exploit, reuse, or copy any of the content included on the PracticaTest website. No website user may act on behalf of PracticaTest or publish content or benefit from the brand on sites outside of PracticaTest. It is important to remember that our content's copyright may not be circumvented under any circumstances, except with prior written authorization from PracticaTest. Necessary legal actions will be taken in case of forgery or copying of content.

5. Access to content

There are three levels of users differentiated by the content they can access. PracticaTest Premium users will have access to the complete course, including over 3,000 tests, audiobooks, and the full syllabus. They will also be able to contact the personal tutor assigned to them upon purchasing the complete course, available from 9 AM to 9 PM, Monday through Friday. Messages sent outside these hours will be attended to by tutors within 24 hours. Registered users will have access to 2,500 tests including quick tests and DGT tests, as well as a personal area and statistics on their progress. Unregistered guest users may take quick tests and receive their results at the email address they provide upon completing the exam. Only registered users and Premium users may access the discussion forums, with the freedom to read and post all their questions. PracticaTest does not guarantee that all tests are up to date and correspond to the current tests published by the DGT. However, PracticaTest guarantees that tests are updated weekly, with the aim of ensuring they properly correspond to the official and current DGT tests.

6. Prices

Each study mode offered by PracticaTest indicates the price of the service without any additional discount. The prices shown on the website include applicable VAT and any other corresponding taxes. PracticaTest may occasionally offer limited discounts and deals for some of its users that may reduce the standard price for a limited time. The prices on the website are final prices, and users will not need to pay any extra amount during their learning process on the website.

7. Payments

To make payment for the various courses that PracticaTest offers, users will have three payment methods: Credit or debit card (Visa, Mastercard, Visa Electron), bank transfer, or PayPal. The credit or debit card used for payment must have been issued by a Spanish bank, and the user will be required to provide details such as the card number, expiration date, and CVV to ensure payment security. To make a payment by bank transfer, the user can obtain the account number from the PracticaTest payment page. The user's account will be activated once payment is effectively received in PracticaTest's bank account, which may take up to three days depending on the issuing bank. For PayPal payments, the user will be redirected to the official PayPal page, where they can enter their details and make the payment immediately. The payment information provided by the user is transferred through Secure Payment Gateways that guarantee the security of their banking data. PracticaTest does not store any of your banking data after the purchase of the corresponding course. Once payment is made, an email will be automatically sent to the address provided by the user with the payment invoice and the steps to follow to access their personal area. PracticaTest is not responsible for any incidents that may occur during the payment process caused by the platform used to make it (PayPal or banking institution). Failing one or more official DGT driving exams does not entitle the student to claim a refund of the amount paid to PracticaTest.

8. Refer a friend

PracticaTest offers its users the opportunity to benefit from a 5 euro discount on the regular price of the complete course by inviting their friends and family. The discount will be applied to the price of the complete course, and the invited user must be new to PracticaTest and not a former student. Registered users will have a "Refer a friend" button in their personal area and on the PracticaTest homepage. Through this link, the user can enter the email of the person they wish to invite to benefit from PracticaTest's services, and a welcome email will be sent to them. PracticaTest reserves the right to cancel a discount voucher without prior notice if improper or fraudulent use is detected. The 5 euro vouchers are not cumulative with each other or with other offers. Limited to one discount per person.

9. PracticaTest's liability

PracticaTest disclaims all liability based on any misuse that the user may make of the website, or in future actions prompted by decisions based on PracticaTest content. PracticaTest is not responsible for personal opinions and comments that users may post unilaterally in the discussion forums or through other means, although they will be moderated to ensure their proper functioning. PracticaTest may occasionally include advertising content on its website related to the website's subject matter, for which PracticaTest is not responsible as it is offered by operators external to the site.

10. Modification of the terms of use

PracticaTest reserves the right to modify the above terms of use whenever it deems necessary or when the circumstances that gave rise to them change substantially. It is therefore necessary for the user to stay up to date with their content and read them each time they access the website.
